Currently a CON is not needed for MRI in counties with populations of 250,000 or greater. The proposal would lower the threshold to 175,000 and likely add Montgomery and Williamson counties to Davidson, Shelby, Hamilton, and Knox counties with more to come pending population growth.

Increases the percentage of beds that a hospital may expand every 3 years from 10% to 25% without a CON.

Eliminates the need for a new CON if a facility with existing CON that leases its location moves within 2 miles.

Eliminates CONs in tier 4 counties(typically more economically stressed) for MRI, independent ERs, outpatient diagnostic centers, ambulatory surgery centers, and home health services. This would likely include Lauderdale, Lake, Hardeman, Mcnairy, Grundy, Fentress, Cocke, Perry, Clay, VanBuren, Morgan, Scott, and Handcock counties.

To view HB 75 click here.
